By accessing or using LumaPulse ("Service"), you agree to be bound by these Terms and Conditions. If you disagree with any part of these terms, you may not access the Service.

Description of Service

LumaPulse is an AI-powered digital marketing assistant provided by Glorious (16 Inc). The Service offers:

• AI-driven marketing campaign planning and strategy
• Multi-platform content creation and optimization
• Competitor analysis and market insights
• Image generation and creative design tools
• Memory system for personalized marketing advice
• Analytics and performance tracking

User Accounts and Registration

To use certain features of the Service, you must register for an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain the security of your password and account
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use
• Be at least 13 years of age to create an account

Subscription Plans and Payment

3-Day Free Trial:

• Limited to 10 messages per day
• Basic AI model access
• Up to 3 memory slots
• One trial per user/device

Basic Plan ($29.99/month):

• 70+ messages per day
• Basic AI model access
• Up to 25 memory slots
• Priority support

Pro Plan ($79.99/month):

• 285+ messages per day
• Advanced AI model (most precise)
• 75+ memory slots
• Priority support and custom integrations

All subscriptions automatically renew unless cancelled. You may cancel at any time, and cancellation takes effect at the end of the current billing period.

Auto-Renewal Cancellation:

To cancel auto-renewal of your subscription, you must do so through your Personal Analytics page. This is the only method to cancel your subscription renewal.

Important Refund Policy:

• If your subscription auto-renews and you did not cancel it through the Personal Analytics page before the renewal date, we are unable to provide refunds for the renewed subscription period.
• To avoid unwanted charges, you must cancel your subscription before the renewal date through the Personal Analytics page.
• When you cancel your subscription, you will retain full access to all features until the end of your current billing period.
• We strongly recommend checking your renewal date on the Personal Analytics page and cancelling well in advance if you do not wish to continue.

Acceptable Use Policy

You agree not to use the Service to:

• Violate any laws or regulations
• Infringe on intellectual property rights
• Generate harmful, offensive, or inappropriate content
• Attempt to reverse engineer or exploit the AI systems
• Share accounts or resell access to the Service
• Abuse trial periods through multiple signups
• Use automated systems to access the Service without authorization
• Interfere with or disrupt the Service

Intellectual Property Rights

Your Content: You retain ownership of all marketing materials, business information, and content you provide to LumaPulse. By using the Service, you grant us a license to process and analyze this content to provide our services.

AI-Generated Content: Content generated by LumaPulse AI belongs to you and can be used freely for your marketing purposes. However, we cannot guarantee that AI-generated content is entirely original or free from third-party rights.

Our Service: All rights, title, and interest in LumaPulse, including our AI models, software, and platform, remain with Glorious (16 Inc).

Disclaimers and Limitations

The Service is provided "as is" without warranties of any kind. We do not guarantee:

• The accuracy or effectiveness of AI-generated marketing strategies
• Specific marketing results or ROI from using the Service
• Uninterrupted or error-free service
• That AI-generated content will be unique or copyright-free

You are responsible for reviewing and validating all AI-generated content before use.

Limitation of Liability

To the maximum extent permitted by law, Glorious (16 Inc) shall not be liable for:

• Any indirect, incidental, special, or consequential damages
• Loss of profits, revenue, data, or business opportunities
• Marketing campaign failures or underperformance
• Third-party claims arising from your use of AI-generated content

Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

Termination

We reserve the right to suspend or terminate your account if you:

• Violate these Terms and Conditions
• Engage in fraudulent or abusive behavior
• Fail to pay subscription fees
• Use the Service in a way that harms our platform or other users

Upon termination, your access to the Service will cease, but you may download your data within 30 days.

Changes to Terms

We may modify these Terms at any time. We will notify users of material changes via email or through the Service. Continued use after changes constitutes acceptance of the new Terms.

Governing Law and Disputes

These Terms shall be governed by the laws of the United States. Any disputes shall be resolved through binding arbitration in accordance with applicable arbitration rules.
